Cancellation & Refund Policy
At Amaya Charters, clear communication and a fair, reliable booking process are especially important to us. This policy applies to all yacht charter bookings made with Amaya Charters. If plans change, we always try to work closely with our guests and local partners to find a practical and fair solution, while respecting the yacht-specific terms and the commitments already made for each reservation.
Effective policy version: September 1, 2026. The policy group that applies to a booking is determined by the yacht selected and the terms shown and accepted when the booking or deposit is made.
Deposit
Any required deposit reserves the selected yacht and date and is credited toward the agreed charter total. Refundability of the deposit is controlled by the yacht-specific cancellation policy below.
Group A: Jackie, Sin Nombre, Agavero and Diva
Cancellation
- Cancellation at least 7 calendar days before the charter start: 100% refund of amounts paid.
- Cancellation less than 7 calendar days before the charter start: non-refundable.
- No-show: non-refundable.
- If the required remaining balance is not completed before departure, amounts already paid are non-refundable, subject to mandatory consumer law.
Payment methods
- Cash: no payment surcharge.
- Zelle: 3% surcharge.
- Venmo: 3% surcharge.
- Credit card: 7% surcharge.
The customer is responsible for ensuring that at least one offered payment method can be successfully used when payment is due. Bank, card or provider declines, account-access problems, insufficient available funds or payment limits do not create an independent right to a refund.
Smoking and documented damage
Smoking is allowed only on the rear swim platform. Smoking is prohibited inside the yacht, on the bow, on seating areas and in any other non-designated area.
Documented smoking or cigarette damage attributable to the booking party may result in the following repair or damage charges:
- Vinyl seats: MXN 3,000.
- Synthetic teak deck: MXN 2,000.
- White yacht surface: MXN 1,000.
These smoking and damage terms apply only to Group A yachts and do not automatically apply to any other yacht.
Captain Jack
- Cancellation at least 7 calendar days before the charter start: 100% refund of amounts paid.
- Cancellation less than 7 calendar days before the charter start: non-refundable.
- No-show: non-refundable.
Group A payment methods, payment surcharges and smoking or damage terms do not apply to Captain Jack unless they are expressly included in the terms shown for that booking.
Group B: Fairline 65 ft and Maiora / Majesty
Cancellation
- Cancellation at least 15 calendar days before the charter start: 100% refund.
- Cancellation less than 15 but at least 7 calendar days before the charter start: refund of eligible amounts paid minus an MXN 4,000 cancellation fee.
- Cancellation less than 7 calendar days before the charter start: non-refundable.
- No-show: non-refundable.
Payment methods
- Cash: no payment surcharge.
- Credit or debit card: 9% surcharge.
The 9% card surcharge will be clearly disclosed before the customer elects to pay by card. Group A Zelle, Venmo and 7% card surcharge terms do not apply to Group B.
Weather and authority decisions
If the captain or operator, marina, port authority or another competent authority determines that the charter cannot safely or legally operate because of unsafe weather or an official restriction, Amaya Charters will offer rescheduling or an applicable refund.
If the charter is cleared to operate safely and legally but the customer chooses not to attend for personal reasons or personal weather concerns, the normal yacht-specific cancellation policy applies.
Policy version and booking record
At booking or deposit, Amaya Charters records the yacht or product, applicable policy group, cancellation and payment terms shown, policy or terms version, acceptance timestamp, deposit paid and agreed charter total. An already accepted booking will not be silently changed to a newer, less favorable policy.
Nothing in these terms limits any non-waivable rights available under applicable consumer law.
